Terms of Service
⚠ IMPORTANT SAFETY WARNING
Summova is a recreational tracking app only. It is NOT a safety device and must NEVER be your sole means of navigation, communication, or emergency response.
Outdoor activities — including but not limited to hiking, trail running, climbing, scrambling, wild swimming, and mountaineering — involve serious and potentially fatal risks. You assume ALL such risks by using this app.
ALWAYS carry a physical map, compass, and charged communication device. ALWAYS tell someone your planned route and expected return time. DO NOT rely on this app in an emergency.
1. Agreement to Terms
By downloading, installing, or using Summova ("the App", "Service"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws. If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and the operator of Summova.
2. Eligibility
You must be at least 16 years old to use Summova (or such higher age as required in your jurisdiction). By using the App you represent that you meet this age requirement. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3. Outdoor Activity Safety
Summova is designed to record and share outdoor activities. Outdoor activities carry inherent risks including, without limitation:
- Serious injury or death from falls, rockfall, avalanche, or terrain hazards
- Getting lost or stranded in remote or unfamiliar areas
- Exposure to extreme weather including hypothermia, heatstroke, and lightning
- Drowning, river crossings, and flash floods
- Physical exhaustion, cardiac events, and medical emergencies
- Wildlife encounters
YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR YOUR OWN SAFETY AND THE SAFETY OF YOUR COMPANIONS DURING ANY PHYSICAL ACTIVITY.
Before any outdoor activity you should: check weather conditions and mountain forecasts; tell a responsible person your exact planned route and expected return time; carry appropriate navigational aids (physical map and compass), food, water, and emergency supplies; know your physical limits; and turn back if conditions deteriorate. Summova, its developers, and any affiliated parties accept no responsibility whatsoever for injury, illness, death, or any other outcome arising from your physical activities.
4. Navigation & GPS Disclaimer
GPS and mapping features within Summova are provided for recreational interest and post-activity review only. They are NOT suitable or intended for primary navigation in any circumstances.
GPS accuracy can be significantly degraded by mountainous terrain, dense tree cover, buildings, atmospheric conditions, and device hardware limitations. Distance, elevation, pace, and route data displayed in the App may be inaccurate. Elevation data is derived from device sensors and third-party datasets and is not surveyed or certified.
DO NOT use Summova as your sole navigational tool. Always carry a physical OS map and compass and know how to use them. Summova accepts no liability for navigational errors or their consequences.
5. Sky & AR Camera Feature
The Sky / AR Camera feature uses your device's camera, magnetometer, and accelerometer to overlay an approximate constellation guide on a live camera view. This feature:
- Is intended for casual stargazing interest only and is NOT astronomically certified or scientifically precise
- Should only be used while stationary and in a safe location
- Must NOT be used while walking, driving, cycling, climbing, or operating any vehicle or machinery
- Is NOT suitable for professional astronomical observation, navigation, or any safety-critical purpose
Constellation positioning depends on device compass calibration, GPS accuracy, and sensor precision. Results may be inaccurate. Summova accepts no liability for any consequence arising from use of the Sky feature.
6. Peak Detection & Medal System
The peak detection system automatically logs peaks when your recorded GPS track passes within a defined radius of a known summit. Detected peaks and awarded medals (Munro, Corbett, Graham, Donald, or Hill) may be inaccurate due to GPS drift, mapping data errors, or device limitations.
The medal classifications used in the App are based on publicly available hill-bagging lists. Summova does not guarantee that these classifications are current, complete, or accurate. The App is not affiliated with any official hillwalking, mountaineering, or bagging organisation.
Peak detection does not constitute evidence that you safely or legally ascended any summit. You are responsible for obtaining any required permissions, following Leave No Trace principles, and ensuring you have the skills and equipment to safely complete any ascent.
7. Apple Health & HealthKit
If you grant permission, Summova may read from and write to Apple HealthKit. This includes workout data, step counts, and related health metrics.
Summova does not use HealthKit data for advertising or share it with third parties for commercial purposes. Health data is used only to enhance your in-app experience (e.g. displaying step counts, syncing activities).
Summova is NOT a medical device. Data from the App must not be used to diagnose, treat, or manage any medical condition. Always consult a qualified healthcare professional for medical advice. Summova accepts no liability for health decisions made based on App data.
8. User Accounts
You may create an account using an email address and password. You are responsible for all activity that occurs under your account. You must notify us immediately at help.summova@gmail.com if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.
9. User Content
You retain ownership of content you create (posts, photos, captions, activity data). By posting content you grant us a non-exclusive, royalty-free, worldwide licence to display, store, and distribute your content within the App and its associated services for the purpose of operating the Service.
You are solely responsible for your content and must ensure it does not: violate any law; infringe third-party intellectual property or privacy rights; contain defamatory, hateful, or offensive material; or disclose personal information about others without their consent.
We may remove content that violates these Terms without notice.
10. Prohibited Conduct
You agree not to:
- Post illegal, harmful, threatening, or offensive content
- Harass, bully, stalk, or threaten other users
- Impersonate any person or entity
- Attempt to gain unauthorised access to the Service or other users' accounts
- Use the App for commercial advertising or solicitation without our written consent
- Scrape, copy, or redistribute App content or data
- Circumvent or interfere with security features of the App
- Violate any applicable law, regulation, or third-party right
11. Third-Party Services
Summova uses the following third-party services to operate the App:
- Supabase – database, authentication, and file storage (servers may be located outside the UK/EEA)
- Mapbox – mapping tiles and route rendering
- OpenStreetMap – open geographic data
- Apple Push Notification Service (APNs) – push notifications
- Apple HealthKit – health data integration (iOS only)
- RevenueCat – in-app subscription management
- Sightengine – automated image moderation
Each third-party provider operates under their own privacy and terms policies. We are not responsible for the practices of these third parties.
12. Intellectual Property
All App content, design, code, branding, and features not belonging to users are owned by or licensed to Summova and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from App content without express written permission.
13. Disclaimers — No Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
We do not warrant that: (a) the App will be available, uninterrupted, or error-free; (b) GPS, distance, elevation, pace, constellation, or peak data will be accurate; (c) defects will be corrected; or (d) the App is free from viruses or harmful components.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUMMOVA AND ITS DEVELOPERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO: PERSONAL INJURY; DEATH; PROPERTY DAMAGE; LOSS OF DATA; OR ECONOMIC LOSS.
IN JURISDICTIONS THAT DO NOT ALLOW FULL EXCLUSION OF LIABILITY, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM OR (B) £10 (TEN POUNDS STERLING).
Nothing in these Terms limits liability for death or personal injury caused by gross negligence or wilful misconduct, or for fraud or fraudulent misrepresentation, to the extent such limitations are prohibited by law.
15. Indemnification
You agree to indemnify and hold harmless Summova and its developers from and against any claims, damages, losses, costs, or expenses (including legal fees) arising from: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
16. Termination
We may suspend or terminate your access at any time for violations of these Terms, with or without notice. You may delete your account at any time via app Settings → Danger → Delete Account. Upon termination, provisions that by their nature should survive (including Sections 13–15) will remain in effect.
17. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales for any disputes arising under these Terms, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
18. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes via in-app notification or email. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Summova regarding the App and supersede any prior agreements.
